These Terms & Conditions (“Terms”) govern your use of the websites, applications, forms, communications, and services (collectively, the “Services”) offered by Scorpion Capital Group (“Scorpion,” “we,” “us,” or “our”).

1. Eligibility

2. Services Provided
Scorpion offers business funding solutions, including but not limited to lines of credit, business cash advances, and merchant cash advances.
Submitting an application does not guarantee approval or funding. All financing is subject to underwriting review, verification of information, and final approval by Scorpion or its funding partners.
3. Application Process
By submitting an application, you:
Authorize Scorpion and its partners to collect, verify, and evaluate the information you provide.
Consent to credit, bank, and identity checks as needed to process your request.
Agree that Scorpion may contact you by phone, text, email, or other methods regarding your application or related services.
Message frequency varies. Message & data rates may apply.
Reply STOP to opt out of marketing messages, or HELP for assistance.
4. Accuracy of Information
You agree to provide truthful, accurate, and complete information and to update it as necessary.
Scorpion is not responsible for any losses or delays caused by false, incomplete, or outdated information.
5. No Guarantee of Funding
All financing decisions are at the sole discretion of Scorpion and/or its lending partners.
Terms such as rates, fees, repayment schedules, and funding amounts vary by applicant and are disclosed in writing before acceptance.
6. Fees & Payments
Scorpion does not charge upfront fees to submit an application.
Any fees or costs related to a financing agreement will be disclosed in your final contract and must be accepted by you before funding.
7. Intellectual Property
All content, trademarks, and materials on our website or provided through our Services are owned by Scorpion or our licensors.
You may not copy, distribute, or use them without our prior written permission.
8. Limitation of Liability
To the fullest extent permitted by law:
Scorpion and its affiliates are not liable for any indirect, incidental, or consequential damages arising from your use of the Services.
Our total liability for any claim is limited to the amount you paid (if any) directly to Scorpion for the Services giving rise to the claim.
9. Indemnification
You agree to indemnify and hold harmless Scorpion, its officers, employees, and partners from any claims, losses, or damages resulting from your use of the Services or violation of these Terms.
10. Privacy
Your use of the Services is also governed by our Privacy Policy (see separate document).
By using the Services, you consent to our collection and use of information as described there.
11. Governing Law
These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict-of-laws principles.
Any disputes will be resolved in the courts located in Georgia.
12. Changes to These Terms
We may update these Terms at any time.
Changes take effect immediately when posted, and continued use of the Services means you accept the updated Terms.
